Veronica Brill, a worker in the poker room, tweeted about some suspicious plays by Mike Postle. Members of the 2+2 Forum, led by poker YouTuber Joey Ingram, sifted through hours of footage of Postle making absurd performances as well as winning at an unthinkable rate. Coupled with the incessant checking of his phone in his lap, this led many to believe he was receiving real-time information from the control booth about his opponents’ hole cards. Since Stones used RFID readers to create the visuals for their live streams, a number of employees, many of whom were acquainted with Postle, were aware of the exact cards that each player was holding.

Regrettably, all that came out of this case was the exposure of a shocking gap in California’s anti-gambling legislation. Despite the fact that Postle and Stones were sued, the case was dismissed due to a law that has been in effect since 1851 (!) and states that claims related to gambling debts cannot be arbitrated in court, even if there is alleged cheating involved.

As for the state’s modern gambling laws, the casinos were first established by the state’s indigenous population. Local governments have no authority to prohibit such businesses, as the Supreme Court ruled in 1987. In 1997, after a decade of debate, the Gambling Control Act was enacted, outlining the steps necessary for non-Native Americans to run betting businesses in the state legally.

The Gambling Control Act was enacted in 1997, as we mentioned upfront. That statute is still in force today. The law mandates that operators of gambling establishments in California must register with the California Gambling Control Commission for a permit (CGCC). $500 is required for the application and is non-refundable.

Two separate agencies are responsible for the regulation in California: the aforementioned CGCC as a stand-alone organization and the Bureau of Gambling Control under the California Department of Justice.
